In the event that LandlordsUnited.co is found liable by a court of competent jurisdiction despite the exclusions listed above, our total aggregate liability to you for any and all claims shall not exceed the total amount of subscription fees paid by you to LandlordsUnited.co during the twelve (12) month period immediately preceding the event giving rise to the liability.
3. Peer-to-Peer Community & User-Generated Content
3.1 Member Accountability: LandlordsUnited.co provides communication channels (forums, chat rooms, regional chapters) to foster peer support. We do not independently verify, endorse, or guarantee the accuracy, safety, or legality of advice, claims, or "tenant red-flag alerts" posted by individual members. You are solely responsible for verifying any information shared by other users before acting upon it.
3.2 Prohibited Conduct: Members agree not to use the platform to:
- Post or transmit defamatory, libelous, harassing, or unlawful material.
- Share personally identifiable information (PII) of tenants in violation of state or federal privacy laws (including Fair Credit Reporting Act guidelines).
- Engage in anti-competitive behavior or illegal price-fixing regarding rental rates.
4. Subscriptions, Billing, and Cancellations
4.1 Auto-Renewal: By signing up for a subscription tier (Basic, Pro-Shield, or Elite Portfolio), you authorize LandlordsUnited.co to automatically charge your provided payment method on a recurring basis (monthly or annually) until you cancel.
4.2 Cancellation Policy: You may cancel your subscription at any time through your account dashboard. Cancellations will take effect at the end of the current billing cycle; LandlordsUnited.co does not issue prorated refunds for partial months or unused community access.
5. Indemnification
You agree to defend, indemnify, and hold harmless LandlordsUnited.co and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your violation of any term of these Conditions.
- Your violation of any third-party right, including without limitation any tenant privacy right or property right.
- Your violation of local, state, or federal landlord-tenant regulations through the use of forms downloaded from our platform.
6. Governing Law & Arbitration
6.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California / Delaware, without regard to its conflict of law provisions.
6.2 Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, rather than in a court of law. You explicitly waive your right to participate in a class-action lawsuit against LandlordsUnited.co.
7. Changes to These Terms
LandlordsUnited.co reserves the right to modify or replace these Terms at any time. We will notify members of major changes via email or through a prominent notice on the Platform. Continued use of the Service following the posting of changes constitutes acceptance of those changes.
